A woman has been found guilty of murdering her one year old son for a chance to travel to the United Arab Emirates. Delivering the judgement, Judge Anne Ong’injo handed her a 10 year sentence.
Happening at the Mombasa High Court, the judge concluded that the prosecution had proven that Happy Mwenda was guilty beyond reasonable doubt. She committed the crime by throwing the son into a borehole.
According to reports, Happy had found an opportunity to work in UAE. And realising that the son was a hindrance, she had to get rid of him for her to travel. She committed the offence on July 2022 in Bombo area, Kisauni in Mombasa County.
“This court has considered that the innocent and vulnerable child who depended on the accused died because of her selfish interests. She got rid of him so she could travel to UAE.”
The court learnt that the accused was attending training in preparation for a job in the UAE. On learning that the kid was the only obstacle, she had to do what she did.
The judge also noted that the deceased was one year old, therefore dependent on the accused for protection. Being a single mum, she was responsible for security of the child. Which she violated.
The judge continued in her statement:
“The accused, under the cover of darkness, inflicted injuries on the child with the intention of causing harm and ensure he didn’t survive. She threw him into the ten foot borehole.”
However, the accused pleaded leniency, claiming she was a first time offender. She said she is sorry and she’s a mother of other two children. The court couldn’t hear any of it. The judge said that she must learn that she has no right to take life as “she cannot even create a strand of hair.”
The accused will serve 10 years in prison for the crime.
