A petition seeking to remove Chief Justice Martha Koome from office has been filed before the Judicial Service Commission (JSC), NewsProjector can confirm.
According to Michael Kojo Otieno, the Petitioner in the case seeking to remove the Chief Justice, she failed to follow the law in appointing members of the tax appeal tribunal, therefore unfit to hold office.
“While appointing persons to serve at the tax appeal tribunal, the judge failed to be honest in the execution of powers conferred to her by the Tax Appeal Tribunal Act based on powers conferred to the judge as a judicial officer.” read the petition to remove Chief Justice.

In the petition, Otieno argues that Martha Koome was not transparent and diligent, adding that she discriminated against persons who had applied to be members of the board which goes against thr constitutional office she holds.
“The actions of the chief justice in appointing members more than the stipulated requirement violated section 4b of the Tax Appeal Tribunal Act. The actions of the chief justice in the appointment of the tax appeal tribunal are indeed illegal, null and void and hence unfit to hold public office.”
This comes after several push and pull between the Judiciary led by Chief Justice Martha Koome and the Executive, which is the Government following rullings that go against the executive, thus the conflict.
However, the Chief Justice has mantained that nothing could deter her from performing her mandate and delivering rullings according to the law. She added that judges should not be intimidated in any way and should ensure they deliver there rullings in accordance with the constitution.

However, the executive led by President William Ruto has insisted that recent rullings have been made through corruption and not the law. Insisting that corrupt judges should be removed from office.
Majority Leader Kimani Ichung’wah also said that they are working on a plan to cut budgetary allocations to the judiciary in a bid to ensure that the judiciary rules in favour of the Executive on government projects and policies.
