The murder trial of former Migori Governor Okoth obado and two others has been adjourned in a case where he’s been accused of killing Sharon.
The case has been adjourned to Tuesday to allow the prosecution enough time to supply the defence team with crucial documents necessary for the case. This made the judge move the case to Tuesday for the documents to be availed.
Call records from Safaricom running up to more than 500 pages are the documents in question that the prosecution needs to provide the defense team with. This is necessary court procedure to ensure the defense team to prepare well for the case and suspect representation.

Defence counsels led by Kioko Kilukumi, Roger’s Sagana and Elisha Ongoya told the court they had initially been supplied with data for various phone number subscribers which was less than 50 pages.
This is not matching with the evidence presented by the prosecution that includes over 500 pages from the Safaricom records concerning the matter.
“The cumulative size of that data supply is 50 pages. If the data we are now expecting is more than 500 pages, then it is completely new information. That falls within the parameter of trial by ambush.”
This forced Judge Cecilia Githua to direct that the defense be supplied with the needed evidence by Monday (today) 2PM to allow enough preparation time for Tuesday.
“I hope going forward you will be more diligent, it’s not fair that we allocate a date for a hearing only for the matter to be adjourned.”
The three accused persons, Okoth Obado, his personal Assistants Oyamo and Obiero are being tried over the murder of Sharon Otieno and her unborn baby that took place on September 3, 2018, in Homa Bay County.
