A day after claims that Magistrate Monica Kivuti was inhumane in her ruling about the wife of police officer who shot her was sick and on life support, Judiciary has come out to respond to these claims.
In a statement on Wednesday, Judiciary alleged that the wife had repeatedly failed to appear in court, resulting in multiple arrest warrants prior to the in-court tragedy.

However, on the day of tragedy and shooting, the prosecution determined that the medical documents she presented in court to justify skipping the appearances were fraudulent.
It’s due to these new discoveries that the prosecution requested the court, by extension Monica Kivuti to remand the suspect, terming her as a flight risk due to her continued absense in court sessions.
Court documents further reveal that the defense of the said woman responded by apologising for presenting fake medical documents and that the misinformation was provided by the accused and her shooter husband.
This forced Magistrate Kivuti to order that the accused be remanded in Langata Women’s Prison pending a pre-bail report. The magistrate also ordered an ambulance to accompany her to the hospital if necessary.
She further ruled that the case to be mentioned on June 27th, 2024, with a hearing on August 6th, 2024. Immediately after the ruling, the irrated husband drew out his gun and shot the magistrate multiple times.
This comes after Former Law Society of Kenya accused Magistrate Kivuti of being inconsiderate and inhuman in her ruling, claiming that the woman was a cancer patient on life support at the time of ruling.

Monica Kivuti was buried on Saturday after succumbing to gun shot wounds inflicted by the husband of the accused who was also shot and killed on the spot by court officers.
