The judiciary has been accused of starting the process of transferring judges who are actively handling corruption cases or have refused ODPP’s intimidation
Transferring Judges: Particularly, the transfer of Senior Principal Magistrate Eunice Nyutu from Nairobi to Keroka Law Courts shortly after handling critical corruption cases raises concerns on the current independence of the judiciary.
This comes after Chief Justice Martha Koome held a meeting with President William Ruto in Statehouse on how to solve a tiff that was brewing between the executive and the Judiciary.
According to reports, Nyutu’s commitment to upholding justice and her refusal to bow to such pressures from the Office of the Director of Public Prosecution (ODPP) has led to her dismissal from the high court to Keroka.
Nyutu has been in the fore front to challenge the prosecution and hold them accountable for what she perceives as attempts to undermine the judicial process which according to her, prosecution fails to up their game in most corruption cases despite thr loopholes that can be noted in the case.
In addition, Her rejection to the Office of the Director of Public Prosecutions requests to drop charges against prominent figures, including close allies of President William Ruto, may have brought her into confrontation with the prosecution.
Nyutu has prisided over high-profile corruption cases including the latest Sh65 billion dams suit involving former Treasury CS Henry Rotich on which she lectured the ODPP on undermining the justice process by overlooking the facts and letting the case slide.
