Deputy President Rigathi Gachagua’s Impeachment has hit its first roadblock in court as his allies also quash the attempts by state agencies to prosecute them.
The roadblock, according to reports is by a youth leader who filed a petition before the court seeking to stop the planned impeachment of Deputy President Rigathi Gachagua as the Impeachment plan heats up.
In his petition, the youth leader urged the court to issue orders barring Members of Parliament from tabling any motion on the deputy president’s impending impeachment.

Denis Ndegwa Ndereva claimed that there was no constitutional framework guiding the impeachment of a deputy president and that impeaching DP Gachagua would destabilise the functions of the executive and consequently hamper the country’s development.
“We cannot allow the less fortunate, the people who are working for us to be impeached unconstitutionally. I have filed a petition against this injustice which is about to happen in the parliament. My petition says there is no impeachment model of the deputy president.”
This comes moments after Gachagua’s allies moved to court to stop their impending arrest after the Director of Public Prosecutions (DPP) approved charges against them as proposed by Criminal Investigations agency, DCI.
The ruling, issued by Justice Lawrence Mugambi protects the accused from arrest until the petition presented by MP Ngunjiri Wambugu is fully heard and resolved to prevent any premature actions that might infringe upon the rights of the petitioners.

“Pending the hearing and determination of this application, this court hereby issues a conservatory order restraining the Respondents from arresting, detaining, confining, prosecuting, or in any way interfering with the liberty of the Petitioner/ Applicants.”
