The court of appeal has revoked and upheld the decision of to nullify the nomination of nine Members of the County Assembly (MCA) from Uasin Gishu who had been nominated by the United Democratic Alliance (UDA).
This comes days after President William Ruto and the Judicial head, Martha Koome organised for a meeting at statehouse to resolve the push and pull by the Judiciary and the government.
According to Chief Magistrate Dennis Mikoyan, the government (UDA) had relied on a list that had been declared null and void by the Political Parties Tribunal thus declaring their nominations null.

Additionally, the Court of Appeal ordered the Independent Electoral and Boundaries Commission (IEBC) to degazette their names within 14 days.
The MCAs had moved to the Court of Appeal in September 2023, after the High Court dismissed their appeal and upheld a lower court’s ruling that concluded they had been invalidly nominated.
The Court of appeal through the judge Rueben Nyakundi ordered that the nominated MCAs should vacate their positions with immediate effect.
“The names of the nine affected persons as Members of the Uasin Gishu County Assembly under the special category and the gender top-up list are deleted.”

However, the MCAs did not indicate any sign of appealing the decision having appealed three times with every court from the high court to the court of appeal holding the decision of the lower court terming the nominations Unconstitutional.
According to sources privy to NewsProjector, the top UDA hierarchy has been notified of the decision but they have not yet received the response on what way to proceed.
