The Court of Appeal has extended the 1.5 per cent Housing Levy deductions until a ruling is issued on January 26 2024.
This comes a day after President William Ruto told off corrupt judges who have allegedly been makimg rullings against the government in a bid to derail the government projects.
The appeal brought forth by the National Assembly and the Speaker of the National Assembly Moses Wetangula, the Appellate Court’s three-judge bench ruled that employees still part with the deductions for the fund that was declared unconstitutional by the High Court.
The rulling was issued by a three judge bench consisting of Justice Lydia Achode, John Mativo and Paul Gachoka.
“Upon hearing the parties, all the applications are consolidated as they arise from the same judgment of the High Court dated November 28, 2023. Civil Application No. E577/2023 is designated as the lead file. The ruling on these consolidated applications will be delivered on January 26, 2024.”
The court however mantained that the Housing Levy deductions will continue being on effect till the rulling will be delivered on 26th.

“In the meantime, the status quo obtained as of today shall be maintained until the delivery of the ruling made at Nairobi January 3, 2024.”
This comes after the declaration by the High Court that said The Housing Levy is unconstitutional, made by a three-judge bench made of Justices David Majanja, Christine Meoli, and Lawrence Mugambi on November 28.
Kenyans were also required to give their views on the Bill by December 28, 2023 but the progress of the bill is expected to drag in court after the Vihiga High Court in December 2023, put a pause on the public participation process until the matter is heard and determined.
